Global Health Progress – Terms of Use
These Terms of Use describe the rules regarding your use of the Global Health Progress Web site, www.globalHealthProgress.org. Throughout our Privacy Statement and our Terms of Use, we refer to some words that have special meanings. PhRMA and the Pharmaceutical Research and Manufacturers of America are the names we use to refer to the activities of our whole association. Global Health Progress (GHP) is the name we use to refer to all of the activities conducted under that name, including those at www.globalHealthProgress.org, as well as community-based activities. The Global Health Progress Advisory Committee is comprised of individuals who provide advice and counsel concerning the activities related to Global Health Progress initiative. When we use the words "we," "our," or "us," we mean PhRMA, The Global Health Progress Web site, or The Advisory Committee, as appropriate for the reference.
Scope of these Terms of Use. These Terms of Use apply to the Web site located at www.globalhealthprogress.org. PhRMA also operates other Web sites. These Terms of Use do not apply to our other Web sites. You should review the terms of use posted on other PhRMA Web sites when you visit them.
Rules for Participation in the Web site's Web Logs.
The Web site's Web logs ("blogs") are intended to provide a forum for the discussion of issues related to global health in the developing world. The blogs may only be used for the purpose of discussing these issues. We accept no responsibility for the opinions and information posted on this blog by others.
The blogs shall not be utilized in any manner that violates, or gives the appearance of violating, federal or state antitrust laws or other laws prohibiting anticompetitive practices. Antitrust laws generally prohibit any agreement or understanding inconsistent with the right and obligation of competitors to exercise independent business judgment in their business activities, including pricing their products or services, dealing with their customers and suppliers, setting and executing research and development priorities, and selecting the markets in which to compete. No express agreement or understanding is required—one can be inferred from statements or conduct. Engaging in business-related discussions could put all who participate in such discussions at risk under the antitrust laws. Therefore, participants in the blogs at www.globalhealthprogress.org may not post comments regarding the following business topics:
- specific company prices, pricing practices, discounts, or other terms of sale of products;
- information concerning specific company market shares, salaries, costs, sales territories, or profit margins;
- the selection or rejection of customers, vendors, or suppliers;
- any non-public information about specific company plans for the Global Health Progress initiative
- any non-public information about medicines in the pipeline;
- any confidential business information including company sales, marketing or strategic plans;
- specific costs of research and development of a particular drug or particular company;
- the effects legislation, regulation, or marketplace events might have on individual companies;
- specific business actions companies may take or consider taking in reaction to legislation, regulation, or marketplace events; or
- the ways individual companies make commercial decisions.
Participants may not post any defamatory, abusive, profane, threatening, offensive, or illegal information or material, or use the blogs in any illegal manner.
Participants may not post any information or other material protected by copyright without the permission of the copyright owner.
Participants may not use any words, logos, or other marks that would infringe on the trademark, service mark, certification mark, or other intellectual property rights of the owners of such marks without the permission of such owners.
Participants may not post any confidential information or any information that would infringe on the proprietary, privacy or personal rights of others.
Participants may not use the blogs to solicit or conduct business, including the direct or indirect marketing of users' products or services, in any manner.
Participants should abide by their employer's policies on proper use of company email, Internet access, chat rooms, and any other forms of online discourse.
Participating in this blog discussion is an individual interaction, not connected to the opinions or policies of any company or organization. Every individual is personally responsible for the content in his or her posts and comments. Do not use your employer's name to promote any conviction, nor imply opinions of anyone other than yourself.
By posting material, the posting party warrants and represents that it owns the copyright with respect to such material, has received permission from the copyright owner, or that the material is in the public domain. The posting party further warrants and represents that it otherwise has the full and unencumbered right to post such material and that such posting will not infringe any rights or interests of others. In addition, the posting party grants PhRMA and users of the blogs a non-exclusive, irrevocable license to display, copy, publish, distribute, transmit, print, and use such information or material in any manner, without payment to the posting party.

Our failure to enforce these Terms of Use in every instance in which it is entitled does not amount to a waiver of our rights.
Severability. If any provision of these Terms of Use is held invalid, void or unenforceable, then that provision will be considered severable from the remaining provisions, and the remaining provisions shall remain in full force and effect.
